Acceptance of Terms
By creating an account, accessing, or using the GetMeCare ONTARIO platform ("Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, incorporated herein by reference.
If you are using the Platform on behalf of an organization or employer, you represent that you have the authority to bind that entity to these Terms.
Platform Description
GetMeCare ONTARIO operates an online marketplace that connects Ontario families seeking personal support workers ("PSWs") and caregivers with independently contracted care providers. GetMeCare ONTARIO is a platform intermediary — we are not an employer of caregivers listed on the Platform.
Our services include, but are not limited to:
- Caregiver profile listings and search functionality
- Admin-mediated matching and scheduling between families and caregivers
- Shift tracking, clock-in/clock-out logging, and timesheet management
- Secure payment processing and disbursement
- Compliance verification including VSC and credential checks
- Messaging and communication tools between platform participants
Eligibility
To use the Platform you must be at least 18 years of age and a resident of Ontario, Canada. You must provide accurate, current, and complete information during registration.
Caregivers applying to list on GetMeCare ONTARIO must additionally:
- Hold a valid PSW certificate from an Ontario-accredited institution or equivalent
- Provide a Vulnerable Sector Check (VSC) issued within the past 12 months
- Provide valid government-issued photo identification
- Consent to GetMeCare ONTARIO's compliance review and background screening process
Accounts & Profiles
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify GetMeCare ONTARIO immediately of any unauthorized use of your account.
You agree not to create multiple accounts, impersonate any person, or misrepresent your qualifications, identity, or professional status on the Platform.
Fees & Payments
GetMeCare ONTARIO charges a one-time admin vetting fee of $39 CAD per employer account activation. This fee covers our compliance review, caregiver vetting, and posting of your care request to the caregiver network.
Shift payments are processed only after a completed, dispute-free shift is confirmed by our administrative team.
- All fees are in Canadian dollars (CAD) and include applicable taxes
- Refunds for the vetting fee are available within 48 hours of payment if no caregiver matching has begun
- Disputed shifts are reviewed by GetMeCare ONTARIO admin before any payment is released
- GetMeCare ONTARIO reserves the right to adjust platform fees with 30 days written notice
Prohibited Conduct
Users of the Platform agree not to engage in any of the following:
- Soliciting caregivers or employers to transact outside the Platform to circumvent fees
- Posting false, misleading, or fraudulent information in any profile or care request
- Harassing, threatening, or discriminating against any other Platform user
- Uploading malware, spam, or any content that disrupts the Platform's functionality
- Attempting to gain unauthorized access to any part of the Platform or other users' accounts
- Using the Platform for any purpose other than legitimate care-related activities
Violations may result in immediate account suspension, forfeiture of any pending payments, and potential legal action.
Intellectual Property
All content on the Platform, including but not limited to logos, design, text, graphics, software, and the GetMeCare ONTARIO brand, is owned by or licensed to GetMeCare ONTARIO Inc. and is protected by applicable Canadian intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for its intended purpose.
Disclaimers
The Platform is provided on an "as is" and "as available" basis. While GetMeCare ONTARIO makes every effort to maintain uptime and data accuracy, we do not warrant that the Platform will be uninterrupted, error-free, or free of security vulnerabilities.
Limitation of Liability
To the fullest extent permitted by Ontario law, GetMeCare ONTARIO Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform.
GetMeCare ONTARIO's total aggregate liability to you for any claim arising from use of the Platform shall not exceed the total fees paid by you to GetMeCare ONTARIO in the 12 months preceding the claim.
Termination
GetMeCare ONTARIO reserves the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct harmful to users, third parties, or the Platform's integrity.
You may terminate your account at any time by contacting us at info@getmecare-ontario.com. Upon termination, your right to access the Platform ceases immediately.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
